What does this insurance include?
Past and future claims
Future claims after your policy ends
Your policy will cover claims arising from incidents that happened/occurred during the period the policy was in place, regardless of when the claim is made against you – even if your policy has expired.
This differs from other policies on the market that are on a ‘claims made’ basis where the policy must be in force at the time the claim is made/reported, not when the incident occurred. Therefore, if a claim is made against you, after your policy has expired, a ‘claims made’ policy may not provide coverage to defend the claim, always check with your previous policy provider.
With a ‘claims occurring’ policy, cover will respond providing the policy was in place at the time of the incident, and therefore, there is no need to purchase ‘run off’ cover after the expiry of your policy.
Unlimited retroactive cover
The policy includes unlimited retroactive cover which means cover will respond to work performed prior to the inception date of your Balens policy. The retroactive extension will apply as long as you had an insurance policy in place at the time of the incident, and that policy will not respond (for example a ‘claims made’ policy as described above).
There is a requirement that any claims made under the retroactive extension must be notified to you during the period of insurance with Balens, and that the previous policy which was in force at the time of the incident will not respond. Full details of any previous policy must be provided in the event of a claim.
Terms & conditions, limitations and exclusions apply. Please see the policy document which is available on request.
